Missouri is a Fault-Based State
State laws regarding fault in a car accident vary significantly. Some states are no-fault states, where the good driver does not have to prove fault of the other driver before he or she can obtain money from the insurance company. The tradeoff is that the injured person cannot sue the driver who was at fault for emotional distress, pain and suffering, and inconvenience. Most states, including Missouri, have adopted a fault-based system of auto insurance, where the insurance company pays according to each party’s degree of fault. Nevertheless, you may have to file suit separately for any uncompensated damages. Unlike compensation for bodily injury claims, insurance claims regarding physical damage to your car remain based on fault in all states.
