Rear end collisions are one of the most common types of accidents on the road. In 2006, nearly one-third of all injury crashes were rear end collisions.

Whose Fault?

Usually the car that hits another from behind is at fault, as the law requires drivers to keep a safe following distance in order to stop easily to avoid causing accidents. In Missouri, under most circumstances the “rear end doctrine” applies, meaning that the driver of the rear car is the at-fault driver and negligence is presumed without needing to identify how the car accident occurred. Sometimes the driver of the rear car may also have a claim, though typically not against the driver of the front car but rather a person or bicycle or driver who pulled out too closely to the oncoming front car.

Documentation

Immediately after the accident you should check everyone’s health, call the police, and write down exactly what happened. You should write down every detail you can remember at that moment, as these details may be crucial later when determining fault.

Injuries

Rear end accidents often result in serious personal injury to the occupants of both the front and rear cars. The most typical injuries that victims suffer include neck and back injuries, or “whiplash.” Such accidents may also result in injuries to the head and spine.
